Welcome to galck+.
These Terms of Service (“Terms”) govern your access to and use of galck.org, related websites, online portals, appointment systems, digital resources and other online services operated by galck+.
By accessing or using these services, you agree to these Terms.
If you do not agree to these Terms, please do not use the relevant service.
Certain galck+ programmes or services may have additional rules, consent forms, participation agreements, safeguarding requirements or professional terms. Where additional terms apply, they will supplement these Terms.
2. About galck+
galck+ is an LGBTQ+ rights organisation and coalition operating in Kenya.
Our work includes advocacy, community support, movement building, research, policy engagement, membership coordination, wellbeing initiatives and activities intended to advance the human rights, safety and wellbeing of LGBTQ+ people.

3. Use of the Website
You may use the galck+ website and digital services for lawful purposes consistent with these Terms.
You agree not to:
attempt to gain unauthorised access to our systems;
interfere with website security;
introduce malicious software;
scrape or harvest personal information without authorisation;
impersonate another person;
use our platforms to threaten, harass or intimidate others;
misuse confidential information;
attempt to identify anonymous programme or research participants;
publish information intended to expose or “out” another person’s sexual orientation, gender identity or other sensitive information;
infringe intellectual-property rights;
use our website to commit fraud;
interfere with the availability or operation of our systems; or
use galck+ services for unlawful activities.
We may restrict access where reasonably necessary to protect users, staff, community members, our organisation or our technology.
4. Accuracy of Information
We make reasonable efforts to provide useful and accurate information.
However, website content may occasionally become outdated, incomplete or inaccurate.
Unless expressly stated otherwise, general information published on the website is provided for informational and educational purposes.
You should independently verify information where a decision may have significant legal, medical, financial, security or other consequences.
5. Human Rights and Advocacy Information
galck+ publishes information concerning human rights, public policy, legislation, community safety, advocacy and related subjects.
Such information is provided for general informational and advocacy purposes.
Website content does not constitute personalised legal advice.
Laws, policies, court decisions and government practices may change. Where you require advice concerning your particular circumstances, you should seek assistance from an appropriately qualified professional or organisation.
6. Therapy, Counselling and Mental-Health Services
galck+ may provide or facilitate access to counselling, therapy, mental-health or wellbeing services.
Information on our website regarding mental health or wellbeing is intended for general educational and service-access purposes and is not, by itself, a diagnosis or personalised medical advice.
A professional therapeutic relationship may arise only through the arrangements, consent process and professional interaction associated with the relevant therapist or counsellor.
Therapists and counsellors may be subject to separate professional, ethical and confidentiality obligations.
Emergencies
galck+’s website, contact forms and ordinary therapy booking systems should not be treated as emergency-response services unless we expressly state otherwise.
If you believe that you or another person is in immediate danger or experiencing an emergency, contact appropriate local emergency services or obtain immediate assistance from an appropriate healthcare or emergency provider.
No Guaranteed Outcome
Therapy and counselling outcomes differ between individuals.
galck+ does not guarantee any particular medical, psychological or personal outcome from counselling, therapy or wellbeing services.
7. Appointment Booking
Where our website allows you to book appointments:
you must provide information that is reasonably accurate;
appointments are subject to availability;
galck+ may need to reschedule appointments because of therapist availability, technical issues, emergencies or other circumstances;
you should notify us when you cannot attend a scheduled appointment; and
repeated misuse of appointment systems may result in restrictions.
Specific cancellation, rescheduling or attendance rules may be communicated separately for a particular service.
8. Community Safety and Confidentiality
galck+ serves communities that may face discrimination, stigma, violence and security risks.
Users must respect the confidentiality, dignity and safety of other community members.
You may not use information obtained through galck+ programmes, meetings, platforms or services to:
expose another person’s identity;
reveal confidential health information;
disclose someone’s sexual orientation or gender identity without appropriate permission;
harass or threaten another person;
facilitate discrimination or violence; or
deliberately undermine the safety of a participant, staff member, volunteer or partner.
Serious violations may result in removal from a programme, event or digital service and may be reported to appropriate authorities where required or justified by law.
9. Membership
galck+ may provide membership or coalition-participation opportunities to eligible organisations.
Submitting a membership application does not automatically create membership.
Membership may be subject to:
eligibility requirements;
review;
governance procedures;
membership policies;
approval processes;
codes of conduct; and
other organisational rules.
Where separate membership rules conflict with these general website Terms in relation to membership matters, the applicable membership rules will govern those matters.
10. Donations
Donations made to galck+ are voluntary.
Donations may be made using payment methods made available through the website, which may include card payments, M-Pesa, PayPal or offline bank transfers.
By initiating a donation, you confirm that:
you are authorised to use the selected payment method;
information provided in connection with the payment is accurate; and
the funds are not derived from an unlawful activity.
Payment Processors
Electronic payments may be processed by independent payment providers.
Their terms, privacy policies, fraud-prevention systems and processing requirements may also apply to your transaction.
galck+ does not normally control payment-provider systems.
Donation Refunds
Unless required by law or approved by galck+, donations are generally considered final once successfully processed.
galck+ may consider refund requests involving:
duplicate payments;
incorrect payment amounts;
technical payment errors;
unauthorised transactions where appropriately established; or
other exceptional circumstances.
A refund request does not guarantee that a refund will be approved.
Where a payment was processed by a third-party provider, refund processing may also be subject to that provider’s procedures.
Tax Treatment
galck+ does not guarantee that a donation will qualify for a particular tax deduction or tax treatment.
Donors should obtain independent tax advice where necessary.
11. Offline Donations
If you request bank details for an offline donation, galck+ may send payment instructions to the contact information you provide.
For security, donors should carefully verify that payment instructions originate from an official galck+ communication channel before transferring funds.
galck+ will not intentionally request that donors send passwords, PINs, one-time passwords or other confidential account credentials.
12. Newsletter and Communications
You may choose to subscribe to newsletters or other galck+ communications.
You may unsubscribe from optional marketing or newsletter communications using the unsubscribe mechanism provided or by contacting us.
Administrative communications necessary for a service you requested may still be sent where appropriate.
13. Events and Programmes
Participation in galck+ events and programmes may be subject to additional rules relating to:
registration;
safety;
confidentiality;
photography;
accessibility;
codes of conduct;
eligibility; and
safeguarding.
galck+ may refuse admission to, or remove, a participant whose behaviour presents a reasonable safety risk or seriously violates applicable programme rules.
14. Research, Surveys and Interviews
Participation in galck+ research, surveys, interviews or focus groups is subject to any specific participant information and consent arrangements provided for the project.
You should not intentionally submit false information in a way that compromises research integrity.
galck+ may publish anonymised or aggregated findings derived from research and programme activities.
Where personal stories, photographs, quotations or identifiable information are intended for publication, appropriate permissions may be sought where required.
15. User-Submitted Content
Where our services permit you to submit comments, stories, photographs, documents, applications, messages or other materials, you retain ownership of rights you already hold in that content.
You grant galck+ permission to process that content to the extent reasonably necessary to provide the service or fulfil the purpose for which you submitted it.
Submitting information privately to galck+ does not automatically give galck+ permission to publish sensitive personal information publicly.
Separate consent may be required for public use of personal stories, photographs, testimonials or other identifiable materials.
16. Intellectual Property
Unless otherwise stated, the galck+ website and its original content, branding, design elements, graphics, publications, videos, photographs, documents and other materials are owned by or licensed to galck+.
These materials may be protected by copyright, trademark and other intellectual-property laws.
You may access and use website materials for personal, educational, advocacy or other non-commercial purposes where legally permitted.
You may not, without appropriate permission:
falsely claim ownership of galck+ materials;
remove copyright or attribution notices;
use galck+ branding in a misleading manner;
reproduce substantial proprietary materials for commercial exploitation; or
imply galck+ endorsement where no endorsement exists.
Some publications may be subject to separate licences or reuse terms.
17. galck+ Name and Branding
Use of the galck+ name, logo or visual identity must not falsely suggest:
partnership;
sponsorship;
membership;
endorsement;
accreditation; or
official representation.
Member organisations and authorised partners may be subject to separate branding arrangements.
18. Third-Party Content and Links
Our website may link to websites, resources and services operated by:
member organisations;
partner organisations;
payment providers;
social-media platforms;
government institutions;
healthcare providers;
news organisations; or
other third parties.
A link does not necessarily constitute endorsement.
galck+ does not control independent third-party websites and is not responsible for their availability, content, security, privacy practices or terms.
19. Member and Partner Organisations
galck+ works with member organisations, partners, donors, healthcare professionals and other organisations.
Unless expressly stated, these organisations remain legally independent from galck+.
galck+ is not automatically responsible for every action, statement, service or omission of an independent member or partner organisation.
20. Social Media
galck+ may maintain accounts on third-party social-media services.
Your use of those services is also governed by the platform operator’s terms.
Content posted publicly to social media should be treated as public information.
Do not use galck+ social-media spaces to harass, threaten, discriminate against or expose confidential information about another person.
galck+ may moderate or remove content from channels we control where appropriate.
21. Website Availability
We aim to maintain reliable access to our services but cannot guarantee uninterrupted availability.
Services may temporarily be unavailable because of:
maintenance;
technical failures;
cybersecurity incidents;
internet disruption;
third-party service failures;
circumstances outside our reasonable control; or
improvements to our systems.
We may modify, suspend or discontinue website features where reasonably necessary.
22. Cybersecurity
You must not attempt to:
access restricted systems without authorisation;
bypass security controls;
obtain another user’s credentials;
introduce malware;
disrupt our servers;
conduct unauthorised penetration testing;

Suspected security vulnerabilities should be reported responsibly to galck+ rather than exploited.

To the extent permitted by law, the galck+ website and general website materials are provided on an “as available” basis.

the website will be free of every cybersecurity threat;
third-party links will remain available; or
use of general website information will achieve a particular result.
Nothing in these Terms excludes obligations or protections that cannot lawfully be excluded.
25. Limitation of Liability
To the extent permitted by applicable law, galck+ will not be responsible for indirect, incidental or consequential loss resulting solely from use of, or inability to access, general website content.
This limitation does not apply where liability cannot lawfully be excluded or limited.
Nothing in these Terms is intended to exclude responsibility for fraud, wilful misconduct or other liability that applicable law does not permit us to exclude.
26. Your Responsibility

maintaining the security of devices you use to access our services;
protecting login credentials where applicable;
ensuring information you provide is reasonably accurate;
complying with applicable law;
respecting other community members; and
evaluating whether public disclosure of information about yourself could create privacy or security risks.
If you believe an account or communication channel associated with you has been compromised, contact us as soon as reasonably possible.
27. Suspension or Termination of Access
galck+ may suspend or restrict access to a service where reasonably necessary because of:
serious violations of these Terms;
security threats;
harassment;
fraud;
unlawful activity;
safeguarding concerns;
misuse of our systems; or
conduct that creates a significant risk to other users or galck+.
Where appropriate, we may provide notice or an opportunity to address the issue.
28. Changes to Services
galck+ may change, add or remove website features, programmes or digital services.
Information describing programmes does not guarantee that a programme will remain available indefinitely.
Programme availability may depend on funding, staffing, partnerships, eligibility requirements and other operational considerations.
29. Changes to These Terms
We may update these Terms from time to time.
The “Last Updated” date indicates when the Terms were most recently revised.
Your continued use of our services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
Material changes may also be communicated through appropriate channels where necessary.
30. Governing Law
These Terms are governed by the laws of the Republic of Kenya.
Any dispute relating to these Terms will be handled in accordance with applicable Kenyan law.
Nothing in this provision prevents the parties from attempting to resolve a dispute amicably before commencing formal proceedings.
31. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
32. No Waiver
If galck+ does not immediately enforce a provision of these Terms, this does not mean that galck+ permanently waives its right to enforce that provision.
33. Entire Agreement
These Terms, together with the Privacy Policy and any specific additional terms applicable to a particular galck+ programme or service, form the agreement governing your use of the relevant services.
